I had to move out of state to help a familey member for awhile and left my truck in my moms care.. now my brother has it.and said he is going to put a lien on the title. But I never took or asked him for any money.now he won't let me get my truck.what can I do?

I am assuming the title never left your name?

If that is the case I would ask him again... and let him know you don't want to call the police... but you will if you have to. You own it... and he is refusing to give it back to you. THey will back the person who's name is associated with the VIN. Meaning the person it is titled to.

I also am assuming he didn't have to pay any taxes fees or registrations or insurance during the period he had it.

If he did... because some localities don't allow a vehicle with a lapsed registration, insurance or inspection to sit around, then pay him that money...

Its going to be very difficult for him to put a lien on it... because he is going to have to prove a debt that was secured by that vehicle.

If its in your name report it stolen but be prepared to pay towing and storage fees unless you go with police to pick it up.

Yes its in my name, but he said that he has a 1500.00 bill for my truck saying it was to pay it off but I paid it off before I left and the title was to be sent to my moms house, so they have my title and my truck but I do have my papers from when I bought it with the VIN on it and the co. I bought it from now he is being so unreal that I'm scared to go to my mothers house to go get it I can get another title just want my truck

You can go to the DMV or MVA depending on what your state calls it and apply for a duplicate title...

Call and talk your mothe first... maybe she can mediate this... otherwise you are going to be into a tow bill and a locksmith to cut a set of keys...

Normally nobody can do anything without the title... but if its left on private property there is a mechanism where it can be declared an abandoned vehicle and it can be disposed of or a replacemetn ttile issued.

Take him to court and let him prove it but make sure you have your proof.

And if nothing else works... you can always do what N0help4u just mentioned... I'd save that for last however... its going to be forever ugly in the family if it gets that far.
