I have been living in my apartment for five years and have had the same carpet in it. Now my landlord is threatening to kick me out for old stains in the carpet that come back three weeks later after it is cleaned. Is there a law that requires landlords to replace the carpet after a given number of years or am I responsible for cleaning it every month.

They aren't required to replace it s long as you live there... you could be there 30 years and they wouldn't have to replace it during that entire time.

You live there... its your responsibility to vacuum it or have it cleaned during that period.


Have you ever priced carpet? I'm guessing you haven't being a renter... who can afford to replace it every 5 years? Not even most homeowners can afford to do it every 20.. It's only going to get replaced between tenants and only when it needs it. They get to make that decision.

The landlord doesn't have to replace it.
You don't have to clean it at all. You have to leave it in a 'reasonable' wear and tear condition for the number of years you lived there, when you move out.
Not many stains come back after being cleaned except for pet urine and grease, or anything that soaks below the pile.

(If something really a health hazard like pet urine and feces is in the carpet, then the landlord has the right to evict you, and sue you for damages, and/or take your security deposit.)

Thank U, this was very helpful, time to move! I refuse to clean the same reoccurring stains out of old carpet that needs to be replaced. You can clearly see the high and low spots in the carpet, it's ridiculous.

My states landlord tenant law is that they are to replace the carpet every 5 years. Technically I would only ask if and when it is in really bad shape.

I bet if you read closer that is only if the unit is vacant... as in between tenants. Some people have so much stuff you can't replace it when the unit is occupied.
