Married with H1B but wife and kid have no H4 and not in US
    Hi,

I am married and just arrived in US last July 1 2013. My wife and kid are planning to get an H4 but not planning to stay here in US. What marital status will I use at W4? How many tax deductions can I use?

Even though she is not here in the United states, you can still file jointly with your wife. You will have to claim all world-wide income for 2013, but the Foreign Tax Credit (Form 1116) should mitigate any extra tax. She will have to apply for an ITIN. Unfortunately, you will nit be able to claim the child.

Claim MARRIED status with two allowances on the W-4.
