I have been brought back to san benito county from santa clara on a probation violation that resulted with a termination of prop 36 and placed on drug court. I was told I cannot transfer my case to santa clara.. is this legal?

Drug court has control and they do not have to transfer you.

Even if there is no gainful employment in this county? Is it entirely based on their approval and not a matter of lagality?

You have the right to leave drug court and follow the rules that the court has for leaving the program. I assume it is either jail or probation

This is part of your acceptance when you agreed to allow case to go there
