Is This A Hostile Work Environment For Mental Impairment?
Today I was yelled at by a co-worker (not superior.) He began to yell at me, I had our boss come in and said "I wish to handle this professionally." The co-worker stormed out of the office and yelled "he's useless."

Now I suffer from severe depression, a mental impairment. Under Title VII of the Civil Rights Act of 1964 and other federal authority. "Derogatory or intimidating references to an employee’s mental or physical impairment are grounds for a hostile work environment."

Is this a valid claim to file with the EEOC? As calling a depressed person useless does affect our mental health considerably.

    Thank you

Is this person who yelled at you aware of your depression? You could take it to the EEOC if you don't value your job because you could very well lose it.

Yes, you are in a protected class, however, this could possibly be handled better internally.

No this individual is not aware of my depression, as I do not have to disclose my condition.

    Thank you for your response

My father was a depressed person, so I understand where you are coming from.

As I said, you are better off handling this internally. Follow the chain of command and go to your immediate supervisor first. If that doesn't work, go to HR.

Best thing though, and I know it's hard with depression, is to just shrug this off as the other co-worker had a bad day.

My immediate supervisor is dating the person whom yelled at me today. The person who yelled at me is HR. Were a small company. How should I handle this?

    Thank you for your support
