    I would like to live with my Mom instead of my Dad
    I am 15, almost 16, in Louisiana and I live with my dad because he has custody. My mom used to stay with us, even though they where divorced, but my dad made her move out. She used to have a drug problem, but went to Rehab and did the 12 step program and is now clean. My dad now has a new wife and step children. I do not even feel like I live here anymore. When I am here I stay in my room and leave out of it to eat or use the bathroom. He is at work for two weeks and home for one, so I am pretty much here with my step mom most of the time. I used to be able to go stay with my mom and go places with her, but my dad recently decided that he does not want that to happen anymore. I really miss my mom and she misses me. I keep asking my dad to let me stay with her but he won't let up. I am getting tired of it and want to go live with my mom. She has a stable place to live, has no personal income but has income from the person she is staying with while looking for a job, transportation and all of that kinds of stuff. Is it possible for me and my mom to go to a judge to see if I can live with her instead of my dad? And do I have a say of which one I want to live with?

    You can tell your dad that you miss your time with your mom and see what he says. Do you get to talk with her on the phone?

    I have tried talking with my dad telling him that I miss my mom, but he says that it does not matter, he does not want me to stay with her and that won't change.

    Is there a court ordered visitation schedule? If dad is violating it mom can take him to court over that. The bottom line is mom needs to go to court to petition for a change in custody. At your age, the court will listen and give weight to your preference. But the decision will still be their's.

    If mom is truly clean it will help, but if she isn't, its probably not going to happen.

    I would like to add to what Scott said. Even if your mother were to petition the court, with her history, and the fact that she has no income but is living off someone else's income, the chance is slim that the court will allow you to move in with her.
