    I864 Affidavit of Support
So I'm applying for adjustment of status through marriage. Problem is wife USC works but doesn't file for taxes. Joint sponsor makes enough to cover I864. But I don't know how wife not filing for taxes will affect my case and possible solution to this..

    Thanks

Tax return of 3 years back needed, even with joint sponsor.

Why did she not file? If it's because her income is so low that she is not required to file, then according the instructions, you should attach an explanation stating so. If it's because she's evading taxes, well, that's another story.

A copy of the tax return for only the last year is required, but the "total income" number from the tax returns from the last 3 years need to be filled on the form.

I-864 instructions, part 6 #7. Item Number 14. Federal Income Tax Information.

You must provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

Isn't a transcript or a photocopy of a return pretty much the same as providing the return - ?
