    Can a Testamenary Trust be removed from a will?
    My brother is trying to remove a testamentary trust from my fathers will he took the large assets that is suppose to fund my trust now he is saying there is no money.

    First, any question on law needs to include your general locale as laws vary by area. Second, without know anything about your grounds for a suit and what it all about we can't advise.

    OK, I found your other post and merged them, please don't start multiple threads over the same issue.

    You should first try asking for a full accounting of the estate from the probate court. I wouldn't try suing in another court until I had exhausted the resources of the probate court.

    As far as not being able to afford an attorney, I think you can't afford NOT to have one. Have you tried talking to attorneys? If you are in line for a sizable inheritance, they may take the case on spec.
