Hi, I staying away from my husband form past 8 months continuously. He is studying in TN, US. And I came in NJ US on H1B working visa, just 2 months bac. I want a separation from him. Can I file it?

You can file for separation or divorce, but should hire an attorney. As long as you have an unexpired work visa and work for the same company the visa was granted for, you are eligible to stay in the US and work. Your status as a non-national does not exclude you from being able to file for divorce or separation. As I stated, the best thing would be to contact an attorney.
