    What can I do if am not in the united states and my husband died while he was filing for me to go to the united states? On the day of is death I spoke with the funeral home from my country so that they know he was married,I also fax copy of marriage certificate to them and they put on is death certificate that he was unmarried, He died leaving behind one child who is 15 who is also aware of her dad marriage to me,when I requested for the death certificate they told me I can't get it because my name is not on it, and they are with holding information from me I don't know what cause my husband death are when he was buried and where he was buried. I also request it from vital chek and they said I can't get it anyone can have a marriage certificate, I don't know if they are doing this because am from another country, what can I do am confused I need help I miss my husband so much.

    Sorry... but its time to give it up (the green card part)... because he would have to sponsor and support you for the time after you were here as part of the process... and if he's dead... he couldn't do that.

    As to the rest... you would have to be able to prove everything with documentation (like a marriage certificate). They can't simply take you word for it.

    Its because of privacy laws... and the very real threat of identity theft and fraud. It has little to do with you being in another country because if you couldn't prove you were entitled to that info even as a citizen here you wouldn't get it.

    Is there a U.S. Consulate near you? Was your child born in America and born during the marriage? If the child is his and he was from the U.S. then its possible you are entitled to benefits from the U.S. government. The benefit would be survivors benefits for the child through his SSI ( Social Security ).
