    I was unexpectedly given an EtG test and had drank the night before.. Have been tested for 13 months prior and has never been given an EtG test before. Is it legal to do this when I wasn't told to avoid certain products? Can I use this as my defense?

    You say you weren't told to avoid certain products but then you also say you drank the night before... so you're saying they didn't tell you to avoid alcohol? And you're asking if the test is legal? Is this for probation?

    EtG test positive at 1200 and now sent back for urine alcohol test.
    Is it possible to tell the difference between incidental exposure and actual alcohol consumption?

    Not with EtG, I don't think. That's the gripe about it -- lots of false positives.

    That's the thing ! My counselor said she will send it back for an alcohol urines test and see if I was really drinking..

    But you admit that you were drinking... so why the surprise?

    Or am I reading it wrong and you're just hoping they might consider it to be incidental exposure?

    No, I'm in two different programs.. And one I do EtG all the time and was made very aware to avoid certain products.. The other has never done so and popped one on me and I was using sanitizer and I have skin cream for my psiorasis that has alcohol in it and used it all before I knew I was getting tested.. Just don't see how she can see if it was incidental or drinking!

    You've been tested for 13 months, for alcohol use. You just said you drank the night before the test. Yes, it's legal. They shouldn't have to tell you to avoid drinking, that's pretty darn obvious.
