I am a mother of a 9 year old boy. I have seen him very little over the past two years. My ex husband refuses my court orderd visitation. I have lack of money for a lawyer so I have to do the court thing on my own. I have had a few visitations with my son this past winter because I finally got enough to go court and get a GAL. My ex has stopped the visitations again saying my son doesn't want to see me. My question is this.. can the court take my visition away because my son says he doesn't want to see me? It is clear to the GAL that this has been put in his head by his dad. I am just not sure the judge will see it. I live in Ohio. I am just wondering if 9 is too young for him to be taken too seriously. I have witnesses that we had fun when we were togather. He does love me.

They listen to the kid but put little weight on it unless it has to do with abuse. Is he telling the GAL that you are mean or anything like that? You need to keep documented every missed visit and the excuse and take it to court because it is a Court ORDER they should enforce it

The custodial parent must get the child prepared for court ordered visitation. But they don't have to force the child to go with the NCP if the child refuses.

If your ex is not presenting the child, then he is in violation of the court order. Hopefully the testimony of the GAL and the father's refusal to adhere to the court order will help you.

Either way I think they need to report it and have the GAL talk to the child and possible counseling because often the one parent 'speaks' for the kid or puts it in the kids head.
