    I have an unauthorized occupant who will not leave residence after the legal tenant was evicted and moved out because of not paying rent.

    Removing unauthorized person from rental
    I am trouble removing a man from rental home. He was allowed to move in by the legal tenant. There is no written rental agreement, only verbal. It was agreed upon that she was to be the only adult along with her children to occupy the home, she let her male friend move in. She was served with a 3 day eviction notice for non payment of rent, failure to transfer utilities into her name, and violation of a verbal agreement. She has moved out the problem is he won't. We notified our local police dept, for an escort to remove him from house, they said he had rights. What exactly are his rights and how to do we get him removed? Is this not trespassing?

    This now makes more sense.

    You gave the tenant notice to pay or quit and she chose to quit.

    But another person, effectively a co-tenant won't leave.

    Do the same to him: give him written notice for the requisite period (to be safe; even if the notice you gave her was addressed to "all occupants", he will probably claiim that he did not receive it). When he doesn't leave, go to court for an eviction order.

    Frankly, I don't believe he has rights. But if the police refuse to arrest him for trespassing, you have no other recourse. I would give him a 3 day notice as well. He is violating the lease as an unauthorized occupant. If he's not out in the three days, go to court for an eviction order.
