I was written up today at work because 9 days ago I passed out and required an ambulance to the er during my shift... I had the flu and didn't know it... I am an non emergency medical driver... I drive people to doctor's appointments... I was written up because I came to work sick and compromised my clients safety... even though I didn't feel sick enough to take offf at the start of my shift... and I passed out while calling my supervisor to let her know I could not continue my shift... what do you folks think?

Sorry, but you must have known you were sick (you say you came to work sick) which does compromise your performance of duty if you drive people to doctors appts.

I think it was appropriate for them to write you up, you say you knew you were sick going on duty.

For heavens sake, you passed out while calling you supervisor.

No I didn't know I was sick enough to take off... only after 4 hours into my shift did the flu symptoms hit me hard... when I came to work I felt a little under the weather... but in no way did I feel bad enough to miss a day at work...

Listen to yourself. "I felt a little under the weather"! That may be fine if you worked in a machine shop. But you don't. You drive people to doctor's appointments. Which means those people may be in a weakened condition and more susceptible to germs.

Even if you didn't deserve the writeup (which you did), there are no laws that say an employer can't enter a writeup in the employee's file unless it is completely false. And even then its questionable about being illegal.

So yes, the writeup was legal AND it was proper.

So what do you want to do about this, fight with your employers and maybe get fired? Take the write up and take it to heart. It sounds like a written warning to not do anything that might hurt a client, sounds simple enough to me. And yes, it is legal.
