    Hi,

    I am on H1 working with an Indian IT company in US. In 2005 I had filled 1040 form for filing the taxes. In 2006 I was in US only for 137 days.
    1. Which form do I need to fill 1040NR or 1040?
    2. Do I need to include my salary I got in my home country(India) in 2006 in my US taxable income if I plan to file for yearly US tax return?
    I want to file my return jointly with my wife who is housewife.

    I would appreciate your prompt response.

    You must file an expatriate dual-status return, which requires preparation of a Form 1040NR with Form 1040 as an attachment. You will pay taxes only on the income you earned while in the U.S.
