    Do my husband and I have a leg to stand on in court?
    My husband and I have custody of my stepson for 4 more months then it goes 2 months on 2 months off with his ex girlfriend that lives out of state. She is court ordered to pay half of all extracurricular activities and half of the medical bills; which she has not done nor even picked them up from the post office, we sent them with a signature confirmation. We recently discovered on a public webpage where she had posted 5 days ago that she thinks pill are the best way out. She has also went 16 consecutive days without speaking to the child, which before that we maybe heard from her once a week. We are wanting to take her back to court for sole physical and sole legal custody I was just wondering if we had a chance of winning? We provide so much better for the child and can continue to give him everything he could ever possibly need.

    Well I didn't put all the information in there she also has court cases against her for not paying bills and has 3 (that my husband and I know about) companies suing her and one has a court order to have her wages garnished but she still has not paid anything on it and that's been over a year ago. She has repeatedly told my husband before the court order for custody that he would not see or speak to his son unless he paid her $400 a month to help support him. Also this is not the only time she has went a long period without speaking to the child, she does it quiet frequently. I know the longer she goes without paying on the medical bills and other items she is ordered to pay the better it is for us but my stepson is starting speech therapy this week so the bill are going to rack up even faster. The part that worries me most is the posting about the pills and whether she is doing things like that in front of the child.

    It will be your responsibility to prove to the courts that the child would be better off with you and your husband. My son managed to get sole custody of his two sons so you may have a chance. Be prepared for anything.

    Thank you we are prepared for anything and everything we have documentation on everything from her lack of calls to her threatening me and how much the child has improved in the last 2 months since he has been in our care we also have proof of her letting the child run with a thermometer and he cut his head open but she didn't do anything about it until 4 days later when it was infected and the doctors couldn't stitch it at that point

    Good - but as Handyman said, you provide all that to the courts in a well organized and provable fashion. You don't need to prove anything to strangers online.
