She can't unless he was ever legally established to be the father through the courts... DNA testing could do that... But I'm guessing it's a bit late for that.
Depends on where you live. In some states they will allow dna to prove paternity after the parent has died. In other states you would have had to establish paternity before the parent passed on.
What state are you in and is it the same state as the father was before passing away ?
It looks like you can establish paternity even though the father has passed on. You might want to ask a family law lawyer in your area for help with this matter and they can direct you on the proper ways to proceed.
