    H1b application and COS
    My h1b case is pending. However, I did receive the notice of action which means I was selected in the lottery. My question is how does the change of status work? My lawyer told me as long as I apply for h1b I don't need to apply/request for a COS? I qualify for a cap gap and if my petition get approved my status will automatically change. Is that correct? I want to confirm that I can keep working without having to go back home when/if my case is approved. I plan on visiting home only in mid October 2013 as I can't go before that. Please clarify. I shall really appreciate. Thanks.

    Additional info:
    Currently on OPT (F-1 sutdent visa)
    Opt expires on: 5/31/13
    F-1 visa expires on: 6/1/13

    Your attorney is correct.. you don't need to file for COS.
