My wife had committed adultery with a good friend of mine in 2009. She left the home and lived with her Mother for 6 months, we shared custody of our 2 children, 3 and 12years old (no court involvment). We reconciled Jan 2010 and wanted to work on marriage. I work from home and I pay for all living expenses (mortgage, house bills, food, etc.. ).

She is 38 and continues to party at least 2 nights a week, and does not come home until the early hours of the morning (3:00am-5:00am). She insists she is not doing anything wrong. I tell her to leave and we should move on and separate. She does not and pretends everything is fine until the weekend (Fri and Sat), and she stays out all night again.

My Son's are hurting because of her not being a proper loving mother. She has a University enducation and is currently back in school getting her masters degree in education.

We live in a small town and most of the people know what she has done and she is not a good wife or mother.

I want to move closer to my family in BC with my kids, and leave her. What to do?

Hire a lawyer and initiate what you should have done before; according to your post she shows no responsibility at all and if she wants to carry on like that, then she can do it after she is divorced.

Sounds like you stand a good chance of getting custody. File for divorce and sole custody. Having a lawyer will help you get it.
