    Tax filing for H4 - dependent - Wife and Son
    Hello Tax Expert.

    I am in USA since 28Nov 2005 till today , Well my wife and my son joined me in USA on 24th May 2006. They were here till 20th Jan 2007.

    Since my wife and son are on H4 they couldn't get SSN. My concern is how should I get Tax Id for them and Is there a separate procedure to get the same. Or I can file my tax return without tax id for them. What are the document I need to provide to IRS for them to provide tax id.

    You need to file FormW-7 to apply for an ITIN for each one. You send the W-7 with a notarized photocopy of their passports with the tax return. Put their names where they beling, but leave the SSN area blank. The IRS will issue the ITINs, insert them in the blank areas, then process the return.

    The information is really helpful. I have only one question now. As mentioned by you that I need to send W-7 with a notarized photocopy of there passports with the tax return. This is for your information that I don't have with me there passport right now. My wife and Son are in India right now for vacation. Is it okay that I will ask them to send me the photocopy of there passport with a notarization taken care of In india or I have to have the photocopy of there passport notarised here at USA only. In that case I need to ask them to send there passport via courier . I am not so comfortable getting there passport via courier . But if its really required then I will do it. Please suggest.

    The notarization from India should be sufficient. I have had several clients submit documents notarzied in India and, to date, no one has said the IRS has rejected the notarized documents.

    Thanks, I got the information I need, but I still have one more question, what should I do with my State Tax (I am in Arizona), should I wait till I get the TIN number for my spouse?
