Is your mother willing to take over custody? Why do you want to?

She goes to Family court and files a petition for custody.

Yes, she was the one who said she wants full custody.

I would give her temporary guardianship. This is fairly easy to do, you can find a form on the WEB to do this, sign it and have it notarized and she can use that to prove she can make decisions affecting the child.

You can then go to court to establish custody.

The court may require the father be contacted.

The father is not around he does not even appear in her birth certificate.

That doesn't matter. He still is part of the legal equation. For some things he may need to be contacted and in many cases such as adoption or a name change the courts will order you to do so.
