I have leased an apartment for 1 year as of Jan. 2012. I continued renting, without any notification from the landlord, for the months of Jan. - April 2013. As of 4/29/2013, I received a Lease renewal, to sign. It states it is, " a rider to and forms a part of the original lease." It is extending the original for an additional 12 months. BUT, the Rental Rate has increased, as well as an "additional deposit". Does Florida law allow; 1.) the period of 4 months to elapse prior to notification & 2.) increase in rent and additional deposit?

Once the original lease expires... you are legally month to month... without a lease... so they can raise the rent at any point.. includiung when you go to sign a renewal. Your option at that point if you don't like it is to refuse to sign... give the required notice and move out.

They can't do it mid-lease however unless its specifically noted in the lease itself in writing as to the amount and when..

As smoothly said this is perfectly legal. When a lease expires, the landlord can raise the rental. Depending on the wording of the lease (many carry automatic renewal clauses), You lease might have renewed.

And yes, if the rental increases they can ask for additional funds to make the deposit in line with the monthly rent.
