My nephew passed away last year,his widow would not let his family see his 4 year old son because she said she needed time to get over the death of her husband (my nephew). She has had more than enough time. She moved in with her parents after my nephews death. I want to see and be a part of my nephew's child's life. I have tried calling her several times and sent her letters, and received no response from her. Now I hear that she no longer lives with her parents, she is now 9 months pregnant and my nephew is not with his mom, he is still with his grandparents (her parents). Does my family have any legel visitation rights to be able to see ans be a part of his life? :confused:

Extended family do not have any legal rights to a child unless court ordered. You may want to contact a family law attorney in your area and discuss your legal options with him/her. Usually an initial consultation is free of charge. If you do decide to file for visitation rights, expect a long uphill battle. Your nephew's parents have a better chance of getting visitation rights than you do. It is a very unfortunate situation. I am so sorry that she is not allowing her son the opportunity to know his father's family. My heart goes out to you.

In some states grandparents can get rights, ( but there are states where even grandparents can not get visitation rights)

A aunt may or may not have any rights what so ever. But only a local attorney can help you on this one.

I am sorry to hear of your loss but unfortunately if you took your nephews widow to court you would not have no rights.
I know this because my partner is in court to see her niece and nephews and the only way that you will have the right in court would be for the government to bring out a legislation for extended family members such as aunts / uncles to see the children they have loved and bonded with.
My partner is currently trying to change this by making a petition for this legislation to be made but for it to be taken seriously it needs thousands of signitures so if you would not mind couls you possibly sign it and post it around your friends / family as I know you understand the importance of this cause. I hope things work out for you in the end! Just keep fighting and stay strong!
