My non biological father is on my birthcertificate and I want to take him off. I want to put my biological father on my birth certificate. My biological father is the one that paid child support on me. I am 35 years old now. And lost my biological about 10 years ago. My mom was married to my non biological father when she had me so she put him on my birth certificate. And now I want to change the fathers on my birth certificate. How do I do this in Oklahoma?

I don't know if it can be done given that your birth father passed away. That said, the person on your birth certificate is not always your biological parent. It does not dishonor your feelings for your father that he is not on the birth certificate.

If you know who he was, that's all that matters.

If it can be done, you would need a family law attorney. You might have to prove that he is your biological father through some measure like DNA testing comparing your DNA to other members of your father's family. If you were adopted by the man who's on your birth certificate, they won't likely change it but if your mother lied about your parentage, I suppose it's possible a court would honor your wishes in this way once you prove who your biological father was.

If your mother was married at the time of your birth that man is considered your legal father and your mother did not have a choice as yo who was named the father.

Also, what do you think will be accomplished by doing so? Since he died 10 years ago, there is no longer an issue of inheritance. That would be the only issue for making a change.

The thing I'm trying to accomplish by doing this is my native american choctaw blood. I have always know he was my father. He used to come and see me and brother all the time. But having. This done well help me and children in so many ways and I'm very proud of my native blood. Thank you

Ok, That's I reason I hadn't thought of, Native American tribal benefits. However, I wonder if that could be accomplished another way. If you bio father paid child support was it under a court order? If so, then its likely the court declared him your legal father. You should be able to use that to get tribal benefits.

Yes I have legel court documents that showed that he had to pay the state of Oklahoma child support and were he paid off the child support I think I was like 25 years old when I got the letter from the state child enforcement that he had paid off all his child support. So I am hoping that will help me. Thank you so much for replying to my concerns on this subject.
