Going to court to say "I stole from my employer, I agreed to pay them back, but I want an exact accounting of what I took and what I owe" won't end badly for them. You're the only one that will pay for that, and if you go to court for it, you wont' be paying only in cash.
So really, no, it's not a good idea. The better idea is to pay back the money they say you stole, and move on.
Do you not realize that this isn't a case where you owed money and they were required to keep records of what you paid, and how much you owe? You broke the law! They're not expected to make a list of exact amounts of what you stole. Nor are they required to take your word for it when you say you only stole a certain amount. Heck, they were never required to agree to let you pay back what you stole, they could have, and should have, called the cops and had you arrested as soon as they found out. They're letting you off easy. If you want to make it hard, call the cops, turn yourself in, and see what happens.
