    Kicking a child out
    My parents still have my 37 year old brother still living at home. They were told by him that since he is getting his mail there, even if he is not paying rent, he is a renter and that they cannot just kick him out. Is this true?

    Its rubbish, it is their house and if he doesn't have a tenency agreement he has no right to stay there. I have my mail sent to my mums house, doesn't mean I can live there rent free!

    Nope. Receiving mail somewhere is not proof of residency. He must show proof of paying rent in writing, the law stipulates; check or a receipt. Since I am sure he does not have any he may be asked to vacate. He is a guest. And he is no longer a child, even though their child. If he does not leave, you can prove a legal 3 days to vacate notice and then contact your sheriff's dept.

    I think that your brother should find his feet and move out! 37 andstill living at home is a big thing does he know how old he is? If he carries on living there he should pay rent. Even though he lives there he is not renting it so your parents could chuck him out.

    What a load of b.s. your brother is giving your parents. If he were a renter, he would be paying rent and obligated to pay rent. Since he is not paying rent, he should be evicted. Your parents can kick him out - they can move his stuff out and change the locks on the doors. Anytime they want to. Today if necessary. He has no legal leg to stand on.

    If they think he's enough of a jerk to take this to court and if he has been paying them something then make sure they give him notice that he has to be out by the end of the month.

    If he hasn't paid a dime and they're fed up, the police will gladly escort him out if it comes to that... 37?

    They may merely change the locks on him while he is out if they want to, if he is not paying any money at all to them for staying there.

    Getting mail is no "legal" status.

    He needs to be sleeping on the street if he is not helping and working and livingthere
