    First, any question on law needs to include your general locale as laws vary by area. However, I don't know anywhere in the US and few places outside the US that will prosecute adultery.

    Technically, if you have sex with someone while married to someone else, you are committting adultery. If you have filed for divorce but the divorce has not yet been granted, you are still married. So, in answer to the question, the date you file for divorce doesn't matter; it's the date your divorce is final which turns adultery into mere fornication.

    Unless you live in a State like California where when filing for divorce you have legal separation as part of the process.
