    Request for waiver of penalty in amendment
    Hi,

    I was on F1 visa in 2010 and 2011. I used Turbo tax to file my returns for last two years which filed 1040/1040EZ forms which are resident forms. I am planning to amend my returns by filing correct 1040NR-EZ, 8843 and 1040X forms for 2010,2011. Do I need to attach my 2010,2011 W2 forms along with these forms ?

    Can you please tell me how I should calculate penalty/interest that I will have to pay if any ? Also, what is the process of requesting a waiver of penalty ? Is there any IRS form that I will have to submit for penalty waiver ?

    No W-2s are needed with the amendments. On page #2 of the Form 1040x, simply ask that they waive penalties abd interest.

    They may waive the penalties, but probably NOT the interest.

    How should I calculate interest/penalty ? Should I mail them a check of (taxes I owe+penalty/interest) or will they contact me after I submit the amendment ?
    By the way what should be the payee's name on the check ? Thanks.

    Let the IRS do these calculations, then bill you.

    Shouldn't I include even the check with 1040x for the taxes I owe ?

    I did not say "Don't mail a check"! Mail the check for the extra tax you owe.

    Just let the IRS calculate the interest and penalties.
