My mercedes was involve in a accident where the officer didn't fault me with a ticket but the damage to my vehicle was a total loss the other vehicle didn't have hardly no damage. A couple of weeks later my car was park in a parking lot and was struck and the driver took off. No witness including myself saw the other person who hit my car. I file another police report. The insurance company at irst agree to cover or pay out for my loss but then discover I had a accident previous on my car. Will my insurance company still cover my damage even if my car had a previous accident where the damage was in the same place of impact

No.. they will only cover the new damage... not the existing damage.

But if they declared it a total loss a few weeks ago... they aren't going to pay anything a second time.. You need to explain this a bit better, its not making a lot of sense as it is.

If after the first accident the car was totalled, the second accident caused no damage.

(Zero value) less (additional damage) =/< (zero value)

So my mercedes was involve in a accident where there was front end damage I had a different insurance company at the time and didn't file a claim on the damages. A few weeks later my car was struck in the front causing severe damage and the incident was a hit and run with no witness. The body shop torn down the vehicle and determine a total loss due to a bent front end frame structure damage. I have a new insurance company and I file a claim on the damage. The insurance company are in the process of determining covering the loss or damage. But the insurance company is waiting to see what the police report say on the earlier accident. Im asking will my new insurance cover my damages and will they cover all tow expense and storage fee and any fee for the tear down to determine repair cost, cause they gave the body shop authorization with my signature to tear down the vehicle to determine repair cost. Im frustrated because of the insurance agreeing at first for liability coverage but now the process is a slow stand still motion. Can you please give me some educated feedback that will be must appreciated.

Ah. Hit and run. You are claiming uninsured motorist coverage perhaps? What is the residual value of a "totaled" vehicle? That's the max they will pay, I expect.

What do you expect? They did a search, found the police report of the earlier accident and now don't know how much of the damage was done while you were insured by them. They might also think you staged this to get your car repaired.

So yes they are going to investigate thoroughly and will probably deny all or part of your claim. You may have to sue them to get them to pay.

Do "we" know where this is? In the US? I'm a liability investigator in the US, but I need more info.

What year Mercedes? Due to their value in my area they are very seldom "totalled."

If the car was totalled in my area at least there was little to nothing left of it, nothing to be damaged in another accident.

Take your photos following accident #1 when the car was totalled out by company #1 and your photos from accident #2 to company #2 and make an argument concerning the "new" damage.

What comes to my mind? Insurance fraud.

Screams insurance fraud to me too the more I read it...

They wreck the car .and leave the scene of the accident... (a crime most places I am aware of).. later they find it cost more than they expected then there is a hit and run (surprise surprise) and they try to claim saying it was like that before... or they positioned it in such a way in such a place to increase the odds of it getting hit hoping for a payout.

I actually know of people that did that... they live on a rural road on a sharp curve... and yet despite lots of room to park... they park the car right in the one spot where if someone missed the turn or slid in the rain their car would be hit immediately... (unofficially helped along by some used motor oil sprinked in the turn on a dark rainy night). And also amazingly every couple years they ended up with a new car as a result...

That was in the days before computerized data records or someone would have gotten wise to them..

Whether the OP's scenario is true or not, it will raise flags to his insurer.

Unfortunately it will raise flags to both companies - and, yes, I've seen it all.

I am still interested in the dollar amount of damage to his Mercedes - mine had $42,000 in damage and they did NOT total it. I was furious, but that's how it goes.

They can have all three of my Mercedes for $42,000. I'll even have them delivered for that... in the USA and none are wrecked. And I'll throw in a low mileage truck as a bonus.

I see many Mercedes, BMW's, and Jags at auction that are about 10 years old or so that go for 5k and under. Perhaps his car was something like that.
