My ex-husband and I were divorced back in 2010, he and his New Girlfriend have went and filled a motion to modify custody for our son, and also put a temporary restraining order in as well... IS this legal? Does this mean I can't get my son back until the court hearing? I have primary custody of my son.

Sure its legal... if he asked for it... and they granted it... that means a Judge agreed to it, and that makes it legal.

Of course its legal to file a motion. The question is whether the motion will be granted.
