He first came to the U.S. and was caught at the border and went back willingly. Crossed again successfully. Married a citizen. He tried to straighten things out. Got a work permit and filed an app. He got an App to go in and was arrested and sent back to Mexico. Many years later he found out his wife, who had been visiting him regularly and had two kids with had cancer. He freaked and crossed the border into the U.S. to take care of her. He's planning on returning to Mexico now that she is fine but we want to know if he has a chance to be with her. With the new reform does he have a chance. Should he go back or does he have a better chance staying?

No felony charges we know of.

He needs to voluntarily go back. If he gets caught again, it could mean prison, then another deportation. When he gets back he can apply for a visa.

    When he gets back?

He NEEDS to go back... and its going to take years before he will be allowed to reapply and even be considered... as long as he stays they will not consider it, the ban period doesn't start until they leave and stay out... his repeat offender status seals his fate on that...

His record is NOT otherwise clean as would be required.
