    Deadbeat brother
    My mother and I have rented a house together for several years. My alcoholic brother recently was kicked out of his own place and my mother allowed him to move in with us. I. Was against the idea because he is bipolar and controlling. How can I evict him at this point? He is not a tenant but a guest in the home.

    If he is a guest you can ask him to leave. If he refuses your local police force will remove him.

    How long has he been there? He very well may be legally considered as a tenant. On top of this, if you and your mother are both renting, I believe you would both have to want him out.

    First, any question on law needs to include your general locale as laws vary by area.

    How recently? Was there any agreement for him to contribute to the household? As he changed his official address? You say you and your mother rent the house together, does that mean you are both signed on the lease? If so, you both have to agree that he should vacate.

    If he is truly a guest (which he may not be) then you ask him to leave. But its unlikely the police will help you since this will be considered a civil, not criminal matter. And, if an eviction is necessary, both lessees must agree.
