Amended 2010 first year choice
Hi,
I have a question about my 2012 tax filing. I came to US on 8 July 2012 on h1B and since then I am in US. I am married (Wife is not working) and have a kid and both of them don't have a ITIN as of now.
I missed by 7 days only to qualify for 183 days timeline to be treated as Resident Alien. So now I am treated as Non Resident Alient so I need to fill 1040 NR and by that I won't be able to treat my wife and kid as dependent so won't able to claim deductions for them.
I also came to know about making First year choice. I read through the entire Pub 519 and first year choice. So I have below questions.
1. Even first year choice doesn't allow you to be treated as Resident Alien for entire year and you have to fiel your return dual status alien which forces you to file as "Married Filing Sepratly" which puts you in higher tax bracket and you can not treat your wife as dependent. Is it true?
2. In order to file as First Year Choice I would need to file Form 4868,to get extension to file and once I become resident alien in 2013 I can make first year choice for 2012. But when I do that I won't be able to apply for ITIN by filing W-7 and so won't be able to claim my wife and child as dependents. Is that right.
3. So is that would be a better option that I file 1040 NR now. And as I will be in us for entire 2013. I will file as resident alient for 2013 in 2014 and get ITIN and then I file amendment for 2012 as First year Chocie and now because I have ITIN I can claim both of them as my dependent.
