    Do I have a legit case to sue someone after,,
    Do I have a legit case to sue someone after pushingme out a moving vehicle and left Me on side of the street unconscious n left waking up in i.c.u without memory of incident but have proof of unnecessary roughness and foul play... I have no medical insurance and I believe she is insured can I sue to cover medical expenses...

    This was the driver? Report the person to her insurance company. Her insurance will find out the facts through interviews with the persons involved and from witnesses.

    I would go to the police. This was a criminal act of assault. Then you can file suit.

    What is your "proof of unnecessary roughness and foul play"? If you don't remember what happened, I assume it is another person who witnessed it.

    And if you were pushed out of a moving vehicle, I suspect that "unnecessary" is redundant. No mater how gently your assailant pushed you, I can't imagine anything that could be termed "necessary roughness", unless of course it was self defense.

    I don't know that automotive insurance covers an intentional tort, but I guess it wouldn't hurt to ask.

    I agree, the driver's insurance will likely not cover this unless being ejected from the car was an accident (faulty door, etc.)
