ANY question on law needs to include your general locale as laws vary by area. Most places have no fault divorces. You have to file for divorce, properly attempt to serve him, then have a court grant the divorce.

If you can persuade the court that you cannot locate him, the court will allow you to serve him notice by publication, of your action for divorce.
