    Joint Suspension
    My husband is on felony probation with a 6 yr joint suspension for a gun charge back in 2009. He has been reporting faithfully for 17 months. He was recently arrested for a misdemeanor obstruction of a peace officer and is now awaiting a probation violation hearing. He has a job and I got a letter from his employer stating his good character and that he has a job to come back to, he has 2 small children whom depend on him and we have only been married 2 months. This is his first violation. Is there a chance he can reinstated or will he more likely get prison time?

    Having a family isn't a valid excuse to get out of time owed for an offense. You can get a job is what they will say to you.

    If they revoke him and make him serve ALL of his probation time is up to the Judge and will be determined on the severity of his new offense.

    I think the odds are good he will go back in.. but its not what I think.. but what the Judge thinks.. and his new charges will sway their decision on if he has learned his lesson or not... getting new charges means he hasn't.

    It depends on the details of the obstruction charge. If you can, I'd hire a lawyer.

    My husband was drunk and as the officer put the hand cuffs on him he tripped on the curb. Female officer said that was his obstruction. Report clearly states he was intoxicated.

    It's hard to say what will happen.. If he's NOT in jail now, I think they'll reinstate him.

    He is in jail

    I guess we will just have to hope for the best and wait to see what happens on Friday. I spoke to his probation officer and he said he is going to put in a good report for him. I hope that helps. Thanks
