HHMI and taxes treaty between France-US
    Hi everyone,

I am currently starting my post-doc position as researcher scholar in the US under a J1 VISA.
I know that there is a taxes treaty between France and US for my VISA category, and I should be exempt of taxes for two years.
BUT, my human ressources (I work for Howard Hugues Medical Institue) told me that I am not eligible for this taxes exemption since the HHMI is not a educational research organism.

Could you help me on that, please?

    Sincerely!

Is the research being done for private profit purposes? If so, then the HR manager is correct.

    Hi AtlantaTaxExpert,

    Thanks for your answer.
No my research will not be done for private profit purpose. But I will verify this with my HR tomorrow.

So, if not, it means that I might be eligible for taxe exemption? How can I explain that to my HR? Do you know a article or a text that explain that?

    Best,

Here is the link to the Technical Explanation to the 1994 treaty. The pertinent article is Article 20:

Suggest you review it before speaking with the HR guy.
