    Quit Claim Deed
    My father passed away recently & my mother wants to remove his name & add my sister's name to the deed. We think the easiest thing to do is to use a Quit Claim Deed. Is that the best thing to do & what do we do with the document once we get it notarized ?

    Ok, first question is was there a will? Second question is how was the house held between your father and mother?

    Depending on the answers to those questions your mother may be able to issue a quit claim deed. Once its done it needs to be filed with the county.

    There is no will. The deed is in both of my parent's names.

    But how? Joint Tenants with right of surivor or what?

    They are joint tenants & I believe with right of survivor. I'm not positive because I've not viewed the deed myself.

    If its with right of survivor, she will need a copy of the death certificate to remove his name. I would suggest getting a title co or rel estate lawyer to handle this so you know everything is done properly.
