I don't think I understand your question.
What Court do you intend to use to sue him? You can't just issue a Summons.
Right, you can't do this on your own without going through the courts. Are you looking to sue him? If so it is not as easy as one might think to then collect on a judgement.
You file suit against him. The clerk of court (in most places) is the official who actually issues the summons. This summons, together with a copy of the complaint by which you instituted the lawsuit, would then be served on him (at your expense; you hire a process server or L.E.O. to do that). It would notify him that if he doesn't want to be defaulted he should do something (like file an answer, for example) within so many days.Quote:
