    Bankruptcy and debt
    I just lost my job and I'm in debt. What can I do? How can I get help filing bankruptcy?

    You need to contact a Bankruptcy Attorney who will review the laws as they pertain to your particular situation and will then advise you how to proceed.

    It is possible to obtain the forms from your local Bankruptcy Court and prepare them yourself, but keep in mind that if you make any mistakes in procedures (including how creditors are listed) that particular creditor will still be able to collect from you.

    I claimed bankruptcy years ago. I was told I could do it myself but it was well worth the money using an attorney. Way too much paperwork and way too many places to make mistakes.

    Do as Judy said... hire an attorney.

    I know that you indicated that you just recently lost your job, and for that I feel bad for you.

    Now, as far as filing for BK 7 or 13, DON'T DO IT. P-L-E-A-S-E DON'T!!

    I'm currently in a BK 13 and it is horrible; I'm bearing treading water. Do whatever you can. If you can, get 2 or 3 part-time jobs because some money is better than no money. Go to the library and read books on managing money. A really good series of books are by Dave Ramsey. He also has a radio show that I listen to everyday to help me stay encouraged and hopefully. Don't sit around and feel sorry for yourself; that's the worst thing you can do. However, if you must do it, allow yourself only 10-minutes a day to do so and then forget about it the other 23 hours and 50 minutes.

    If the Court "forced" you into a Chapter 13 after reviewing your records (income and expenses) it's because you are able to keep up with living expenses but not what is considered extra debt. If you want to opt out of a 13, you can. A 13 filing also indicates you have assets which you do not want to liquidate or lose to your creditors.

    That is not the case with everyone and, as I suggested, a Bankruptcy Attorney is your best source of info, particularly because laws vary by State.

    I don't understand why you filed a 13 if you could have obtained part-time employment and paid your bills as scheduled - ? If you cannot live within the confines of a Chapter 13 filing you need to go back to Court, file a Chapter 7 and forfeit your assets to pay your bills.
