    Can you become a can with a felony in New York state
    Hello anyone reading this. Name is chris and my sister is a can right now. She is going to ask for me at her job, but I figured I would ask here as well. Being I am in NYS, I wanted to ask if anyone knew the criteria about being hired with a felony, in my case 2.

    I am on parole, been on it for one year, have 8 months to go. I am currently working at a retail job making minimum wage and the bills are piling up. My charge was possession of marijuana. I don't know if in NYS being a non violent means anything.

    My sister likes her job, makes good money and I just want to know if I should bother trying if it gets me no where. My options are very limited right now as in what I can get into, but if I could get into this, I would go for it. Thanks

    Found in the Department of Health Regulations Title 10, NYCRR Part 402. If you have been convicted of one of the following offenses, employment in a nursing home or home care agency providing resident care will be disapproved.
    Any Class A felony defined in the Penal Law;
    Any Class B or C felony occurring within the 10 years preceding the date of the
    Criminal history check;
    Any Class D or E felony listed in Article 120, Article 130, Article 155, Article
    160, Article 178 or Article 220 of the Penal Law occurring within the 10 years
    Preceding the criminal history check;
    Any crime defined in Sections 260.32 or 260.34 of the Penal Law occurring
    Within the 10 years preceding the criminal history check; or
    Any comparable offense in any other jurisdiction.
    In addition to these specific categories, there are other criminal convictions or
    Open charges that may affect your ability to work. For crimes that do not fall
    Within the criteria above, the NYSDOH has the discretion to disapprove you for
    Work.
    In all cases, you will be notified by the NYSDOH if you are not considered
    Suitable for employment.
