My fiancé was arrested about a week ago for failing a drug test while on probation. They found a suboxone wrapper (it was empty) in his back pocket. After five days of being in jail, they drug tested him and he failed for suboxone. Can he be charged with possession, or anything? Will they revoke his probation because of this? Also - it is his first failed drug test. What are the odds of him only having to do a 90 day turnaround?

They will probibly revoke his probation over this... thats the reason they do drug testing. To make sure they comply with the terms of the probation.

However... if they will charge him for that (which would be a new charge)... depends on the DA if they think its worth it..
