Me and my husband living separate, but we are still legally married(We were married outside the USA) . And we are green card holders. How can I remove his name from baby's birth certificate? We have 6 month young daughter. She was born in Brooklyn, NY. He does not want to do US Passport for baby, so I can not go back to my family in Europe. What can I do? Thank you.

Very little if anything. The only way you will get his name removed from the birth certificate is if you can prove he wasn't the father. If the father will not sign off on a passport, then you will need to go to court and petition the court for sole legal and physical custody. Which will probably mean filing for divorce. And, unless you can prove to the court its in the child's best interests to get sole legal and physical custody, you won't get it. I would omagine that would be very hard to prove.
