A walgreens pharmacist gave out my medical information to a non family member and has called me from their coorperate office offering me a settlement of $1000 if I don't sue. I work in the medical field and know the seriousness of the violation. I feel violated put off and insulted. How much should I ask for they need to learn that this is unacceptable.

The pharmacist can lose his license, as can the pharmacy. I think it is worth more. How much depends on how much harm was done.
How did it happen? Was a ruse involved by the person asking? Was it the pharmacist or a tech who gave out the info?

An apology. If they did really offer you $1,000, take it. It's gravy.

You can't sue. However you can report it which could result in fines or even loss of license for the pharmacist.

I realize you work in the medical profession, but it's HIPAA, not HIPPA - and that is set up to warn and/or fine the Pharmacy.

Pharmacists (and Techs) can give out medical information to anyone who is authorized to receive it. That person does not need to be a family member.

My late husband was a Pharmacist, owned and operated several Pharmacies. I have never heard of a Pharmacy offering someone a settlement if that person "promises" not to sue. I've certainly seen settlement offers but nothing along those lines, on those terms.

Courts are not designed to punish people or teach them lessons, and that includes this situation. An Attorney - if you can find one to take this case - will charge you 33-1/3% of the settlement plus you will have to pay all Court costs and legal expenses IF you win.

I'd take the Thousand Dollars and run with it.

And I question your wisdom in posting the name of the Pharmacy.
