    Can NCP get custody
    Wondering if a NCP can get custody if the minor child is living with step grandparents while the mother has custody. The grandparents don't have any arrangements in the court order. Is this a violation in any way? Honestly just don't understand if she has custody why is my daughter living with her inlaws instead of her mother.

    The issues is why, for how long and if the NCP has a safe home environment and other issues.

    For the NCP to gain custody, they file for a modification of the custody paper work in court and ask for a hearing.

    For an NCP to wrest custody from the custodian would generally require that the custodian is mistreating the child.

    However, depending on the reasons the custodian is not caring for the child, there may be a case.
