When I was 16 my 21year old boyfriend got me pregnant
I had a bby 4month after turning 17
I kniw its consider rape
But he made me believe he lived me and would look after my son and I
And we put his last name on my son

After 4months after my baby was born he left and never came back or bother to look for him son
If for most 5time he came back
Just so that I wouldn't acuse him of rape
He waited till I turn 18 and left for good

Niw its been 3yeard I have not heard or seen him

I would like to know what can I file for in NY court
But mostly would like to know if I can file for full custudy and remove his lastnme so I am able to take out my son out of the country with out his permision

You will need his permission to leave the country. If you don't then you may face kidnapping charges.

You can file for full custody and child support. You will also have to contact him for a name change.

Your best option is to get a lawyer and have them help you file everything. If the father can't be found then the courts may grnt some things that your asking. But you have to try finding him and document everything.

Do you think he could still face charges for gotten me pregnant. At 16 and him been 21
Or by me putting his last name on the birth certificate it does not count as rape any more?
Or is he free of charges because I have waited to long?

I fell into a big depression and care less about everything didn't think clearly as I do now that I am older
I gusse he really knew how to control me ti the point were he was sure I would not do anything agenst him

What makes you think you can't get him for rape? There is no statute of limitations for statutory rape in NY. And you have iron clad proof that you had sex prior to the age of consent.

I would talk to your local prosecutor about this. It may help in your severing his ties to the child.

Wow thanks for your answer I'm really tired of everything bad that has happened to me
Im now 20and I really want to get my life straighten out
And my boy to just be mine and have nothing to do with some one who just made him and abandon him

Im going to do what you just told me thank you so much
