    Eviction procedure
A mother with a small child was being evicted from their apartment, they had no where to go, I said they could stay for a little while at my home until they could find somewhere else. 4 months later she is still here and when I asked her to leave she said I would have to evict her. I live in Ohio. What are my legal rights as the home owner? Does she have any rights. This was a pity, trying to help someone out situation, now I'm getting screwed. What can I do?

Even though she doesn't pay rent or have a lease she has to be treated as a month-to-month tenant. You have to hand her a written notice that her tenancy is terminated and she must move out within 30 days. If she hasn't left within that time then you have to file a lawsuit for eviction.

You have allowed her to become a resident. That gives her the same rights as any tenant. But, as her landlord you have the same rights as any landlord. So you do what Lisa said and give a vacate notice then follow it up with an eviction order if she doesn't move. And I would suspect this woman knows the system and is playing it. So the likelihood is she will force you to go the eviction route to stretch the time out as much as possible until she can find some other sucker to play.
