    Tenancy Contract
    My tenancy expired and the agent gave me a new contract to sign which I did. My landlord has refused to counter sign and return same to me (I am 6 months into a supossedly 1 year contract). He has refused to repair faulty heater in the house, with repeated requests for over 3 months. Do I have an enforceable contract with him at all? Can I move out immediately?

    Since the landlord has not accepted the lease renewal, you are a month to month tenant. You can give them 30 days (or one rental period depending on local laws) that you plan to vacate.

    But as a month to month renter you have rights to require them to fix needed items in the home.

    If course, if you were to give them a 30-day notice, they could then sign and produce the contaract, claiming that you are bound by the lease/contract.

    The lawyer is right... When you give your notice, do it in WRITING, sent CERTIFIED, return receipt requested... In your letter, say LOUD and CLEARLY that they didn't sign the lease.

    Yes, I should have specified that the notice should indicate that since they did not sign and accept the new lease, You consider yourself a periodic tenant.
