Credit card debt under a Nevada corp
I am in LOS ANGELES, a few years ago I signed up for a cell phone employed by a Nevada corp but had to put my name/info as an officer of the company. Well I am now being sued by an ATTORNEY representing the collection agency of cingular wireless. The summons says I have to answer the court in legal form in 30 days, 2weeks left and also serve the plaintiff. All through the summons it talks about defendant (s) and fictitious names, Etc but I am the only one it appears they are going after. The summons was left on my front door and it also says that I promised to pay the $1100.00 which I never did. Any suggestions would be very helpful, I am no longer affiliated with the corporation and this is also now on my credit report. They don't mention the corporations name but I guess that's covered under the fictitious names they mention several times.

If you were a officer of the corp, you can be responsible, you need an attorney

    Hello N:

I beg to differ with my friend, the Padre (a rare occurance). An officer isn't responsible for corporation's debts unless he signs a personal guarantee. I'll bet that's what you did, because you couldn't get telephone service based on the corporation's credit. Otherwise, they wouldn't have needed your personal information.

You need to find out exactly what IS the case. Why don't you call the lawyer and ask him that very question. You could even ask to see the document you signed. He'll send it. If he doesn't, then answer the summons (see mr yet's stuff), and go to court.

But, if you did guarantee it (and I think you did, because lawyers aren't in the business of doing things that they know they won't get paid for), then you'll lose in court and it will cost you a great deal more than you could settle for now.
