My friend and I had a verbal agreement that she could use my truck if she maid the monthly payment as well as the cost of insurance because I was in a financial bind and was going to let the truck be repossessed. So she has maid 2 payments as well as the insurance payments until this month she has gotten 2 red light tickets from signal light cameras as well as 3 parking tickets. So now she has paid the Parking tickets but not the Red Light tickets totaling $150 and now she owes $150 plus this months Truck payment of $400 insurance payment of $100 so total of $650 and she has changed her number and will not answer or return any of my calls at her work for over 3 weeks the truck is still insured and titled to me in New York State I also have witnesses who were present when we made this agreement thank you

Is she still in possession of your vehicle?

How long was this contract for? Was there a set time, or just as long as she used the vehicle?

Why didn't you get anything in writing?

Is she listed as the primary driver under your insurance policy?

She is still in possession of the vehicle and it was agreed that as long as she maid the payments on time as well as pay the insurance and keep the truck up she would continue to use it as for getting it in writing I know bad mistake on my part we have known each other for 15 years and never had a problem and I also thought that seeing the truck was still titled to me I wouldn't have any problem but again bad call so what I thought of doing is send her a certified letter asking for the truck to be returned as well as the balance she owes and if she don't respond then call the police

There are a few issues with this. Right now you have a verbal agreement, which you acknowledge. I'm assuming that you never listed her as the main driver under your insurance. That's actually insurance fraud. Insurance will cover a temporary driver if they're in an accident, but she's not a temporary driver. Your insurance company is unaware that she is the main driver of your vehicle. They haven't had a chance to look at her driving record, and adjust the cost of your insurance accordingly. This is actually insurance fraud.

I would get the vehicle back immediately. If she gets into an accident, and they find out that she's been the main driver for months, and you didn't notify them, you could end up with a lot more problems than this was worth. I'd forget about what you think she owes. Just get the car back in one piece asap.

Ok thank you should I just call the police seeing she isn't responding and you know I never even realized that about the insurance thank you so much for you advice as well as your time and knowledge greatly appreciate it

Police will do nothing, since you let her have the vehicle, she did not steal it.
You will need to go over to her home and just get the vehicle and take it back to your house.
Perhaps turn it back over to the bank.

Exactly.

Don't talk to her. Just get in it and drive it away. Exactly what a "repo. man" might do.

Hopefully you kept a key.
